Trade Secret Litigation
TRADE SECRET LITIGATION
Trade secrets are an important aspect of businesses that operate in a competitive landscape and can often be a determining factor in their success.
According to the US Patent and Trademark Office, “trade secrets consist of information and can include a formula, pattern, compilation, program, device, method, technique or process. To meet the most common definition of a trade secret, it must be used in business, and give an opportunity to obtain an economic advantage over competitors who do not know or use it.”
STRATEGIES
At Hardin Law our top priority is keeping your company’s trade secrets confidential to ensure your company’s success in a competitive industry. HLG is experienced in devising strategies to avoid the potential of trade secret exposure to the public or a competitor. Our strategies include, but are not limited to:
- Recognizing what potential trade secrets a company possesses. Identifying potential trade secrets ahead of time is key to maintaining success over competitors and allows a company to determine what exactly needs protection.
- Determining whether or not the trade secret can be kept confidential. As a business grows, so does the likelihood that a trade secret will be leaked to the public.
- Planning for the worst. It’s imperative to have a contingency plan in the event that a trade secret is leaked in order to protect the company.
- Restricting trade secret accessibility. To minimize the possibility of a trade secret leak, it is best to limit the number of employees that have access to the trade secrets of the company.
EXPERIENCED TRADE SECRET VIOLATION ATTORNEYS
Attorney James Hardin has 20 years of experience and is the author of “California Trade Secret Litigation, A Practice Guide”. His ability to represent clients comes not only from experience, but also from his extensive knowledge of trade secret litigation.
If trade secrets are threatened, there are protective measures that can be taken to mitigate the damages. These approaches include, but are not limited to:
- Trade Secret Investigation. An investigation is the first step to take if it is believed that trade secrets have been leaked in order to determine the information leaked as well as the party who leaked it.
- Determining Damages Incurred. After the investigation is complete, it is important to estimate the damages incurred due to the loss of the confidentiality of the trade secret.
- Course of Action. Once damages have been assessed and proper evidence has been gathered, it is imperative to determine whether filing suit is the next best course of action.
- Temporary Restraining Order (TRO). A temporary restraining order can be filed during the wait period until a court date to protect the company and to prevent the accused’s further access to trade secrets.
- Preliminary Injunction. A preliminary injunction is a court order that can be filed on behalf of the company to stop the undesired action from continuing until the final court date when the judgement is made.
